This page explains the regulatory status of AJ W. E. Bennetts, Solicitor, the legal services I currently provide and the protections available to clients.
Regulatory Status
AJ Walter Emir Bennetts is a solicitor of England and Wales and is personally regulated by the Solicitors Regulation Authority (SRA).

I practise on a self-employed freelance basis in my own name.
My freelance practice operates under regulation 10.2(a) of the SRA Authorisation of Individuals Regulations and currently provides non-reserved legal services.
AJ W. E. Bennetts, Solicitor is not an SRA-authorised law firm or recognised sole practice. The distinction is important: I am personally regulated by the SRA as a solicitor, but the freelance practice itself is not an SRA-authorised firm.

I currently provide non-reserved legal services directly to clients.
These may include, where appropriate:
- preparation and drafting of Wills;
- preparation of Lasting Powers of Attorney;
- legal document drafting;
- preparation of powers of attorney and other legal documents;
- solicitor certification of documents;
- identity verification services;
- ID1 and ID2 identity verification;
- assistance with FCDO apostilles and document legalisation;
- legal advice relating to non-reserved matters; and
- other non-reserved legal services agreed with the client.
The precise scope of every instruction will be confirmed before I begin work.
Reserved Legal Activities
I do not currently provide reserved legal activities through this freelance practice.
Reserved legal activities are specific activities which, under the Legal Services Act 2007, may only be undertaken in circumstances permitted by law and the relevant professional regulator.
They include:
- the conduct of litigation;
- exercising rights of audience;
- certain reserved instrument activities relating to land;
- reserved probate activities;
- administration of oaths; and
- notarial activities.
Where a matter requires a reserved legal activity which I cannot provide through my freelance practice, I will explain this to you and, where appropriate, recommend that you instruct an appropriately authorised solicitor, law firm, barrister, conveyancer, probate practitioner or Notary Public.
Professional Indemnity Insurance
I do not currently hold professional indemnity insurance for this freelance practice.
Because I currently provide non-reserved legal services under regulation 10.2(a), my practice is not required to maintain the professional indemnity insurance provided by SRA-authorised law firms under the SRA Minimum Terms and Conditions.
This means that clients of my freelance practice do not have the benefit of the compulsory professional indemnity insurance that ordinarily applies when instructing an SRA-authorised law firm.
No alternative professional indemnity insurance is currently in place.
I make this information clear so that prospective clients can make an informed decision before instructing me.
SRA Compensation Fund
Clients may, in certain circumstances, be eligible to apply to the SRA Compensation Fund.
The Compensation Fund is a discretionary fund administered by the Solicitors Regulation Authority. Eligibility and payment are governed by the SRA Compensation Fund Rules and no person has an automatic entitlement to compensation.
The Fund may potentially assist with certain losses resulting from dishonesty or a failure by a solicitor to account for money. It is not a replacement for professional indemnity insurance and does not generally compensate clients simply because a solicitor has been professionally negligent.
Any application is determined by the SRA in accordance with the rules and eligibility criteria applying at the time of the application.

Client Money
I do not operate a traditional solicitor's client account.
Fees for my professional services are payable directly to me.
Where a matter involves payments to a third party — for example an FCDO legalisation fee, government fee, courier charge or another professional's fee — I will explain the proposed payment arrangements before the cost is incurred.
Where appropriate, you may be asked to pay the relevant third party directly.
Fees and VAT
My fees will be explained before I accept an instruction.
Where a fixed fee is advertised or agreed, I will explain what is included within that fee and identify any additional third-party costs or disbursements.
I am not currently registered for VAT. Accordingly, VAT is not added to my professional fees.
Third-party suppliers may charge VAT on their own fees where applicable.
Notarial Services
I am a solicitor, not a Notary Public, and I do not personally carry out notarial acts.
Some documents intended for use overseas require notarisation rather than, or in addition to, solicitor certification.
Where notarisation is required, I may assist you in arranging an appointment with an independent Notary Public.
Any notarial act is carried out by the Notary Public under their own professional responsibility, regulatory arrangements and terms of engagement and is separate from the legal services provided by me.
Where I introduce a client to a notarial practice at which I also work, I will make that connection clear to the client. The notarial service remains a separate service provided by the Notary Public and not by AJ W. E. Bennetts in my freelance capacity.
Apostilles and FCDO Legalisation
My signature is registered with the Foreign, Commonwealth & Development Office for document legalisation purposes.
This means that, where solicitor certification is appropriate for the particular document, I can certify or sign the document before it is submitted to the FCDO Legalisation Office for an apostille.
I do not issue apostilles myself. Apostilles for UK public documents are issued by the FCDO Legalisation Office.
Whether solicitor certification, notarisation, an apostille, embassy legalisation or additional steps are required depends upon the document, the country in which it will be used and the requirements of the receiving authority.
I will explain the appropriate process based upon the information provided to me.
Identification and Verification
As a solicitor, I have professional obligations concerning client identification and the prevention of financial crime.
I may therefore require clients to provide evidence of their identity, address and, where relevant to the instruction, information concerning the purpose of a transaction, source of funds or other supporting information.
I may decline to accept or continue an instruction where I am unable to complete appropriate identification, verification or regulatory checks.
Confidentiality
I am subject to the professional duties applying to solicitors, including duties concerning client confidentiality.
Information provided to me in the course of an instruction will be treated confidentially except where disclosure is permitted or required by law, regulation or my professional obligations.

Complaints
I aim to provide a professional, clear and responsive service.

Please include:
- your name and contact details;
- the relevant matter or instruction;
- what you are unhappy about;
- what you would like me to do to resolve the complaint; and
- any documents or information you consider relevant.
There is no charge for making or investigating a complaint.
I will acknowledge a formal complaint promptly and aim to investigate it fairly and provide a substantive response as soon as reasonably possible.
A final response will be provided within eight weeks of receiving the complaint unless the complaint has already been resolved.
Legal Ombudsman
If I am unable to resolve your complaint to your satisfaction, or eight weeks have passed since you made your complaint without it being resolved, you may be entitled to refer the matter to the Legal Ombudsman.
The Legal Ombudsman is an independent organisation that considers complaints about the service provided by lawyers.
Generally, a complaint must be referred to the Legal Ombudsman:
- within one year of the act or omission being complained about; or
- within one year of when you should reasonably have known that there was cause for complaint;
and
- within six months of receiving my final written response to your complaint where that response properly informs you of this time limit.

The Legal Ombudsman may apply exceptions to its normal time limits in certain circumstances.
Reporting Conduct to the Solicitors Regulation Authority
The Legal Ombudsman primarily deals with complaints about the quality of legal services, communication and fees.
The Solicitors Regulation Authority deals with concerns about professional conduct and breaches of the SRA's regulatory requirements.
Examples of matters that may be appropriate to report to the SRA include dishonesty, misuse of money, misleading a court or another person, serious misconduct or other serious breaches of professional obligations.

Professional Standards
As a practising solicitor I am personally subject to the SRA Principles and the SRA Code of Conduct for Solicitors, RELs, RFLs and RSLs.
Those professional obligations include requirements relating to:
- honesty and integrity;
- independence;
- acting in clients' best interests;
- client confidentiality;
- conflicts of interest;
- complaints handling;
- client information;
- accurate and non-misleading publicity; and
- ensuring clients understand the regulatory protections applying to the services they receive.
